A company has been fined 1,425 for carrying out noisy building works outside set hours despite being served a warning notice.Brentwood Borough Council took legal action after complaints at The Landings, Outings Lane, Doddinghurst.

The site is subject of a  planning application for the demolition of a Doctors Surgery and erection of 8 residential properties.In August last year council Environmental Health officers served a Control of Pollution Act 1974 section 60 Notice on Haynes Building and Development Ltd of Loughton restricting the times and hours during which work could take place.

This meant that noisy works could only take place from 0800-1800 Monday to Friday and 0800-1300 Saturday with no noisy work Sundays and Bank Holidays. However, on Sunday 26th February 2017 noisy work was reported by residents starting at 0715 which included the operation of a cement mixer.

On August 21, Haynes Building and Development Ltd of Loughton pleaded guilty to breaching the terms of the Notice and was fined a total of 1435.

Brentwood Borough Council’s Chair of the Environment and Enforcement Committee Cllr Keith Parker said: “We understand that building work, by default, may be noisy at times but this is the very reason for restrictions being put in place. Residents have the fundamental right to know there will be respite from noise and disturbance and we expect any developer to adhere to these.

Unfortunately, in this case these terms were breached in a wholly unacceptable way. No one could possibly argue that it is anything other than unreasonable for building noise to start at 7.15am on a Sunday morning. Council officers rightly pursued this case on residents’ behalf and I am delighted that the court saw fit to fine this company a significant sum.

This should ensure any company working in Brentwood considers our residents first and foremost and adheres to the rules regarding acceptable working hours and noise. If they do not, they will face the legal consequences.”
