This webpage serves as notice of an appeal under Section 78 of the Town and Country Planning Act 1990 by Fairview New Homes (London) No.2 Limited. The appeal is to be heard at a digital Public Inquiry as outlined below.

The address of the site to which the appeal relates: Brentwood Blood Centre, Crescent Drive, Shenfield, Brentwood, Essex, CM15 8DN. (Please note the postcode has been amended to end 8DN rather than 8DR as confirmed by the appellant and the Inspector).

Description of the proposed development: Redevelopment of the site to provide 86 apartments in 4 separate residential blocks ranging from 2 to 5 storeys, 106 car parking spaces, secure cycle parking, communal landscape provision and other associated development.

What is the date and time of the Inquiry?

Due to COVID-19, it is not possible to hold the Inquiry within the Town Hall Council Chamber. Therefore, the Public Inquiry will be held as a digital event using the Microsoft Teams platform.

The Inquiry will open at 10:00 on Tuesday 7th July 2020 with 5 sitting days currently identified. From the 8th July the morning session will begin at 09.30 and the afternoon session starting at 14:00. It remains the intention of the Inspector that these dates are 7-10th July 2020 inclusive, a site visit will be undertaken on 13th July 2020 with no other identified sessions that day and closing submissions are to be heard the following morning on 14th July 2020. A copy of the draft programme can be found further below on this webpage.

The Inquiry will be split into sessions of no more than an hour and a half per session. For the most part, there will be two sessions in the morning and one session in the afternoon with a break in between.

Who will preside over the Inquiry and determine the appeal?

The Planning Inspector who will preside over the Inquiry is Ms. Joanna Gilbert. The Inspector will hold the power of determination over the appeal.

The Inspector considers the main issues in this case are likely to relate to:

  1. the effect of the proposed development on the character and appearance of the area;
  2. the effect of the proposed development on highway safety and parking; and
  3. the effect of the proposed development on flood risk.
