I should be grateful if you would provide me with the following information in respect of each domestic gas boiler installation reported to the Council's Building Control Department for the period from 1st January 2010 to date:
For the avoidance of doubt, I do not wish to be provided with the name of the householder where the boiler was installed.
This request is made in keeping with the Competent Persons Scheme pursuant to the Building Regulations &c. (Amendment) Regulations 2012 (Statutory Instrument 2012 No. 3119) which amend The Building Regulations 2010 (Statutory Instrument 2010 No. 2214).
As you will be aware, Regulation 13 of the 2012 Regulations require local authorities to store copies of notices and certificates relating to domestic gas boiler installations in a "retrievable form".
With reference to your request under the Freedom of Information Act, you have requested address details of boiler installations. I can advise that it is considered that this request would be exempt under Section 40(2) of the Act.
Section 40(2) of the Freedom of Information Act provides an exemption from release of personal information, if to do so would be likely to breach any of the principles set out in the Data Protection Act 1998. It is considered that addresses of privately owned properties does constitute personal information as ownership details can be obtained from other sources (for example Land Registry). Further, this information has been provided to the council for Building Control purposes and release of it for any other purpose, without consent, would be likely to breach the 2nd Data Protection Principle.
