Storage, Enforcement or Removal of Non Motor Vehicles from the Public Highway

Request

I would like to submit a request for information relating to when and how Local Authorities are able to and have taken action in relation to the storage of non motor vehicles (trailers, caravans, boats, etc) parked on the public highway. This includes the status of non motor vehicles, what options are open to the Local Authority to deal with such matters how complaints relating to non motor vehicles have been dealt with.

1. How many complaints have been received in relation to non-motor vehicles parked on the public highway.

2. For each complaint:
a. Brief detail of the complaint and
b. What action was taken by the Local Authority, this should include:
i. The reason for the action (i.e. abandoned, obstruction, contrary to restrictions, clearer streets, following complains for x, etc.)
ii. The basis, legal or otherwise, that enables the local authority to enforce the removal and / or destruction, etc of non motor vehicles.

3. A copy of the council's policy regarding the storage, enforcement, removal of non motor vehicles (on / from the public highway).

4. Any other information that relates to the authority's activities in this area, including but not limited to: council / committee minutes, internal meeting minutes, correspondence, reports, etc.

Response

How many complaints have been received in relation to non-motor vehicles parked on the public highway - From the 1 April 2012 to 31 March 2013 we received 6 complaints for non motor vehicles

Brief detail of the complaint and what action was taken by the Local Authority - 24 hour notices where placed on 3 of the non motor vehicles that were on the highway, other 1 could not be auctioned as on private land the other 2 could not be found.

The reason for the action - Considered as abandoned or obstruction on the highway

The basis, legal or otherwise, that enables the local authority to enforce the removal and / or destruction, etc of non motor vehicles - The 24 hour notice for abandoned vehicles Refuse Disposal (Amenity) Act 1978. Removal and Disposal of Vehicles Regulations 1986 as amended by the removal and disposal of vehicles (England)(amendment) regulations 2002

A copy of the council's policy regarding the storage, enforcement, removal of non motor vehicles (on / from the public highway) - There is no written policy the Council refer to the Refuse Disposal (Amenity) Act 1978 for this.

Any other information that relates to the authority's activities in this area, including but not limited to: council / committee minutes, internal meeting minutes, correspondence, reports, etc - Non motor vehicles that are considered to be abandoned/hazard on council property are given a 7 days notice also on other private property once the owner has given written permission. Please note that abandoned vehicles are not reported to Council Committee meetings so therefore we hold not reports or minutes on these.
