Non Payment of Business Rates

Request

1. The total number of Magistrate Court Summons issued for non-payment of business rates for the years 2012/13, 2011/12 & 2010/11

2. The total number of cases referred to Bailiffs for collection of business rates after a liability order has been obtained for the years 2012/13, 2011/12 & 2010/11

3. The total number of cases were Bailiffs have been instructed to undertake walk in possession for non payment of business rates after the granting of a liability order for the years 2012/13, 2011/12 & 2010/11

4. From 1st April 2013, 50% of any business rate debt not collected by a Council will have to be paid to Central Government. Please confirm the amount budgeted for the year 2013/14 for remitting back.

5. Please provide copies of all internal e-mails, communication, minutes of meetings, memorandums and presentations by the Council dealing with or mentioning the change in point 4.

Response

1. The total number of Magistrate Court Summons issued for non-payment of business rates are:- 2012/13 - 353 , 2011/12 - 478 & 2010/11 - 299

2. The total number of cases referred to Bailiffs for collection of business rates after a liability order has been obtained are:- 2012/13 - 55, 2011/12- 91 & 2010/11 - 99

3. The total number of cases where Bailiffs have been instructed to undertake walk in possession for non payment of business rates after the granting of a liability order is: 28

4/5 Under the new system, Business Rates will still be collected locally, with 50% being retained by Local Authorities, and 50% being paid over to the Department for Communities and Local Government (DCLG). However, of the 50% locally retained, 10% of this is paid to Major Precepting Authorities, with the remainder retained by Brentwood Borough Council. This value is then subject to a “levy” which is explained in more detailed in the appended documents.
The amount of Business Rates due to be retained by the Council after the levy is £1,449,000 for 2013/14.
