Election candidacy

Request

I have tried for a week now to get a response to my written and e-mailed query over the legitimacy of the candidacy of Cllr Mrs Margaret Brehaut but have failed get even an acknowledgement. So now I need to take this further either to the local commissioner and/or the electoral commission. Therefore please furnish me with the following information under the freedom of information act.
1 What are the residential/working requirements for a Brentwood council election candidate?
2. where has Mrs Brehaut been residing for the last four years and why is her contract phone number a Colchester one?
3. If she has been living in Bentley why has she been taking an approximate £600+ a month in Brentwood Council allowances?
4. If she does not qualify for nomination this year, who allowed it and why?
5. What is Mrs Brehaut's attendance record over the last four years, and how did she vote on the future of the town hall issue?

I have already informed our MP (the Community Services Secretary) of my disquiet and have already stated that I have reserved the right to go public on this issue. I would also like to point out that much of my information comes from Conservative Party sources who are equally concerned.

Response

1. What are the residential/working requirements for a Brentwood council election candidate?
A person must be:-
• 18 years of age
• A British Citizen, an eligible Commonwealth citizen or citizen of a member of the European Union
• At least one of the following four qualifications apply
• You are & will continue to be registered as a local government elector from the day of your nomination & throughout your term of office
• You have occupied as owner or tenant any land or other premises during the whole of the 12 months before the day of your nomination and the day of election
• Your main & only place of work during the 12 months prior to the day of your nomination and the day of election has been in the local authority (this does not required to be paid employment & includes Councillors whose main & only job is being a Councillor, providing their offices are within the local authority area)
• You have lived in the local authority area during the whole 12 months before the day of your nomination and the day of election.

2. Where has Mrs Brehaut been residing for the last four years and why is her contract phone number a Colchester one?
The records that the Council hold show that until 27.10.2009, Mrs Brehaut resided within the Borough. She did not reside in the Borough between 27.10.2009 and 23.3.2012. Contact numbers are provided to the Council by Councillors.

3. If she has been living in Bentley why has she been taking an approximate £600+ a month in Brentwood Council allowances?
Mrs Brehaut was an elected Councillor and therefore took allowances in accordance with the Brentwood Borough Council Constitution.

4. If she does not qualify for nomination this year, who allowed it and why?
Mrs Brehaut qualified for election this year in accordance with the criteria detailed above.

5. What is Mrs Brehaut's attendance record over the last four years, and how did she vote on the future of the town hall issue?
