FOI 12918

Penalties for smoking in cars with children

Request

I am writing to you under the Freedom of Information Act 2000 to request the following information from the council in its role as the local authority enforcement body:

Please provide:a) the number of referrals the local authority has received from police forces regarding people smoking in cars carrying children, since the legislation was implemented in October 2015
b) the number of fines and/or issued by the local authority for this offence as a result
c) the value of fines issued

In case it helps for context, I understand that while police officers can stop cars for this offence, they are unable to issue tickets and must pass offenders' details on to local authority
enforcement officers as they are the only ones with the power to issue a fine or penalty notice.
This BBC article explains the situation in detail: http://www.bbc.co.uk/news/uk-35808647

If it is not possible to provide all the information requested due to the request exceeding the cost of compliance limits identified in Section 12, please advise me as to how this can
be broken down to comply with the time limit. I am happy for you to answer just a) and b) if this helps.
