I would like to make the following FOI request relating to the information at last Friday's Asset Committee.

Item 16 Courage Playing Fields - Shenfield Cricket Club



The above report refers to various documents in the Council's possession that were relied upon in reaching the recommendations.



Copies of those documents are requested as follows :-



1) Para 3.8 : The report and minute of the Leisure Recreation and Arts Committee of 31st March 1993

2) Para 3.8 : The report and minute of the Leisure Recreation and Arts Committee of 7th July 1996

3) Para 3.8 : The report and minute of the Leisure Recreation and Arts Committee of 26th September 1996

4) Para 3.9 : The letter dated 24th May 1996 from the Council to Shenfield Cricket Club

5) Para 3.9 : The file note or record regarding the telephone conversation with the Club referred to in the last sentence of the paragraph.

6) Para 3.11 : The letter dated 20th June 1996 from the Council to Shenfield Cricket Club requesting a meeting

7) Para 3.12 : The report and minute of the Parks and Recreation Committee of 18th November 1996

8) Para 3.13 : The letter of 21st December 2005 from Shenfield Cricket Club to the vets.

9) Para 3.13 : Any letter to the Council from the Vets providing the letter referred to in 8 above.

10) Para 3.15 : Please gives dates and details of the legal challenges referred to regarding ownership of the car park and rights of access from the December 2005 to the date of the report.

The Council responds to your enquiry, using the same numbering as yourself, as follows:

1) The report to this item is no longer available however the minute is attached.
2) It appears that there was an error in the report to 27th March 2015 Asset Committee. I confirm the report should have referred to a previous committee report dated 7th July 1993 (not 1996). The report to this item is no longer available however the minute is attached.
3) It appears that there was an error in the report to 27th March 2015 Asset Committee. I confirm the report should have referred to a previous committee report dated 27th September 1996 (not 26th September 1993) . The report to this item is no longer available however the minute is attached.
4) Under s.40 of the FOIA, there is an absolute exemption the Council from releasing personal information about third parties if disclosure of the third party information would breach the data protection principle. Letter dated 24th May 1996 is personal to the Shenfield Cricket Club and therefore is not attached.
5) Under s.40 of the FOIA, there is an absolute exemption the Council from releasing personal information about third parties if disclosure of the third party information would breach the data protection principle. Letter dated 24th May 1996 is personal to the Shenfield Cricket Club as is the annotation on the letter and therefore is not attached.
6) Under s.40 of the FOIA, there is an absolute exemption the Council from releasing personal information about third parties if disclosure of the third party information would breach the data protection principle Letter dated 20th June 1996 is personal to the Shenfield Cricket Club and therefore not attached.
7) I am unable to access the Councils records for this information but will do so as soon as I am able.

10) Under s.40 of the FOIA, there is an absolute exemption the Council from releasing personal information about third parties if disclosure of the third party information would breach the data protection principle. This request would fall within the exemption and therefore dates and details of legal challenges are not attached.
